Terms of Service

1. Agreement

These Terms of Service govern your use of brodop.ai and any service you buy from BroDop. By using the website or buying a service, you agree to these Terms. If you don't agree, please don't use the website or our services.

2. Who we are

BroDop is operated by BroDop Digital Inc., a New York corporation, at 8705 Sheridan Drive, Buffalo, NY 14221. "BroDop," "we," "us" and "our" mean BroDop Digital Inc. "You" means the person or business using the website or buying a service.

3. Our services

• AI Visibility Audit. A one-time report, priced at $49, that measures how visible your business is on AI assistants. It includes your AI Visibility Score, platform by platform results, a competitor comparison and recommendations. We aim to deliver it within one hour of payment.
• BroDop Boost AI. A monthly service, priced at $999 per month, in which our team works to improve the signals AI assistants use to understand and recommend your business, and reports your progress.
• Other services. BroDop AI Reviews, BroDop AI Ads, BroDop Digital Advertising, BroDop SEO and BroDop Website Development are provided under a separate proposal or agreement. If that agreement conflicts with these Terms, the separate agreement controls for that service.

Prices are in US dollars and may change. A price change never affects a payment you've already made, and we'll give Boost AI clients at least 30 days' notice before a new monthly price applies.

4. No guarantee of AI results

AI assistants such as ChatGPT, Gemini and Perplexity decide for themselves which businesses they mention or recommend. We don't control them, and nobody can guarantee what they say. Except for the guarantee described in section 5, we don't promise that any AI assistant will mention or recommend your business, or that you'll receive any particular amount of traffic, leads, calls or revenue.

Your AI Visibility Score measures how visible your business is to AI at the time of testing, using our published methodology. AI answers change over time and can vary from one question to the next, so your own results may differ from ours.

5. Boost AI visibility guarantee

Boost AI comes with a visibility guarantee.

If your business does not gain at least one new citation from ChatGPT, Gemini or Perplexity within 30 days of your Boost AI start date, we will keep working on your account at no charge until it does. A citation means one of those platforms names your business in its answer; a link to your website is not required. A citation is new if it was not found in your baseline audit, checked using the same audit questions. The guarantee applies only if:

• your Boost AI account is paid and current; and
• you've given us admin access to your Google Analytics 4 (GA4) account within 7 days of your start date.

This guarantee is the only remedy for not meeting it. It is not a promise of refunds, traffic, leads or any particular ranking or recommendation.

6. Payment and billing

• AI Visibility Audit. Paid in full when you order.
• Boost AI. Your first month's $999 is charged immediately when you start. After that, you're charged $999 every month on the same day of the month as your start date.
• Payment processing. Payments are processed by Stripe. We don't store your full card details.
• Failed payments. If a monthly payment fails, we'll email you, and our payment processor will automatically retry the charge up to 8 times over 2 weeks. All work pauses 5 days after the first failed charge and resumes once your bill is paid in full. If every retry fails, your subscription is cancelled.
• Taxes. Prices don't include any taxes that may apply.

7. Cancelling Boost AI

There's no long-term contract. You can cancel Boost AI at any time with 30 days' written notice through the contact form on brodop.ai or by email to your BroDop contact. Your final month is billed in full. We don't give partial-month refunds or prorated credits.

We may end your Boost AI service if you don't pay, breach these Terms, or use our services unlawfully. We'll tell you in writing, and you won't be charged after the end date.

8. What you agree to provide

Our work depends on access to your accounts and accurate information. To start Boost AI, you agree to give us admin access to your Google Analytics 4 (GA4) account, so we can measure AI referral traffic and your progress.

We don't need access to your Google Business Profile or your website today. If a new service needs either of them later, we may ask you for that access.

You confirm that the information you give us is accurate and that you're authorized to give us the access you grant. If you don't give us the access or information we need, we can't be held to any timeline, result or guarantee that depends on it.

9. Ownership of content and reports

You keep ownership of your business name, logos, content and data. You give us permission to use them only to provide our services to you.

We own our software, methodology, scoring and report templates. Your reports are yours to use within your business. You may not resell them or present our methodology as your own.

With your permission, we may feature your business, logo, results or testimonial on our website and in our marketing. You can withdraw that permission at any time.

10. Using the website

You agree not to misuse brodop.ai: no attempts to break, overload or gain unauthorized access to it, no automated scraping, and no submitting false information or other people's details through our forms.

11. Third-party platforms

ChatGPT, Gemini, Perplexity, Google, Meta and other platforms named on our website are the trademarks of their owners. BroDop is not affiliated with, endorsed by or sponsored by them. Their terms and changes apply to them, and we're not responsible for what they do.

12. Disclaimer

Except as stated in these Terms, our website and services are provided "as is." To the extent the law allows, we disclaim all other warranties, including any implied warranty of fitness for a particular purpose.

13. Limitation of liability

To the extent the law allows, BroDop is not liable for indirect, incidental or consequential losses, including lost profits or lost business. Our total liability for any claim relating to our services is limited to the amount you paid us in the three months before the claim arose.

14. Indemnity

You agree to cover any claims against BroDop that arise from content or information you provided, or from your breach of these Terms.

15. Privacy

Our Privacy Policy (/privacy-policy/) explains how we collect and use personal information, including on our website and through our forms.

16. Governing law

These Terms are governed by the laws of the State of New York. Any dispute will be handled in the state or federal courts located in Erie County, New York.

17. Changes to these Terms

We may update these Terms from time to time. We'll post the new version on this page with its effective date. For Boost AI clients, a material change takes effect 30 days after we notify you.
